Victory at MSPB - Attorney Estes Defeats Unlawful Indefinite Suspension Action

April 2024

We are thrilled to announce a significant victory in a recent case before the U.S. Merit Systems Protection Board (MSPB). Attorney Estes successfully represented our client, an Administrative Law Judge of the U.S. Department of Labor, in reversing an indefinite suspension action imposed by the Department of Labor. The MSPB Administrative Law Judge ruled in favor of our client, reversing the suspension due to the Department of Labor's failure to comply with federal law. This outcome not only vindicates our client but also underscores the importance of upholding due process in employment matters for Administrative Law Judges.

In this case, our client was subjected to an indefinite suspension by the Department of Labor without prior approval from the MSPB, as mandated by law. Recognizing the injustice of the situation, Attorney Estes diligently pursued the case before the MSPB, arguing for the reversal of the suspension and seeking justice for our client. As a result of this ruling, our client will receive back pay, benefits, and attorney fees. Additionally, the client's retirement benefits will be recalculated to reflect the time unjustly spent on suspension.

This victory serves as a testament to the importance of legal advocacy in protecting the rights of employees. Employers must be held accountable for following proper procedures and respecting the rights of their workers. Our firm remains committed to advocating for fairness and justice in the workplace, and this successful outcome reaffirms our dedication to our clients' best interests.
