Firm Victory: Attorney Estes Wins at EEOC on behalf of Federal Employee in Non-Selection Case

The Law Firm of Matthew D. Estes is proud to announce a significant legal victory on behalf of a federal employee of the Department of Homeland Security (DHS). Attorney Estes successfully represented the employee in a two-day hearing before an Administrative Judge of the U.S. Equal Employment Opportunity Commission (EEOC).

After a full evidentiary hearing, the EEOC found that DHS unlawfully retaliated against the employee for filing prior EEO complaints against their supervisor. The Administrative Judge concluded that the employee's non-selection for a promotion was a direct result of retaliation — a clear violation of Title VII of the Civil Rights Act of 1964.

As a result of this successful representation, the EEOC ordered DHS to:

  • Retroactively promote the employee to the position they were wrongfully denied,

  • Provide full back pay covering more than two years of lost earnings,

  • Pay the employee over $50,000 in compensatory damages, and

  • Reimburse attorney's fees and costs incurred in pursuing the successful claim.

This decision represents a powerful affirmation of the rights of federal employees to engage in protected EEO activity without fear of retaliation or career harm. It also serves as an important reminder to federal agencies, including DHS, that retaliation against employees who assert their EEO rights will not be tolerated under federal law.
